These Terms of Service (“Terms”) govern your use of fixmypool.pro (the “Website”) and any services provided by FixMyPool (“FixMyPool,” “we,” “us,” or “our”). By using the Website, requesting service, scheduling an appointment, or paying for services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our Website or services.
FixMyPool provides pool diagnostic, repair, maintenance, and related services in the Tampa Bay, Florida area (the “Services”). Services are performed based on conditions that are visible, accessible, and present at the time of service.
Any diagnosis, recommendation, or estimate is based on visible/accessibly testable conditions and information provided by the customer. Pool systems can have hidden or intermittent issues; additional issues may be discovered during or after service. If additional work is needed, we will communicate options before proceeding when reasonably possible.
We do not guarantee the future performance, lifespan, or reliability of any pool equipment, plumbing, electrical components, pool surfaces, or systems. Equipment may fail due to age, corrosion, improper installation, manufacturer defects, prior damage, prior repairs, electrical irregularities, water chemistry, or environmental conditions.
FixMyPool is not responsible for hidden defects or concealed conditions, including but not limited to underground plumbing leaks, structural cracks, pre-existing corrosion, prior improper installation, manufacturer defects, electrical faults, or damage caused by prior service providers. We are not responsible for damage that existed before service or that is unrelated to the Services performed.
Customer agrees to:
Customer is solely responsible for maintaining proper pool chemistry before and after service. FixMyPool is not liable for damage caused by improper chemical balance, customer chemical use, delayed corrective action, algae outbreaks, staining, etching, corrosion, scaling, or environmental factors.
Customer must provide safe access and a reasonably safe work environment. We may refuse or stop work if conditions are unsafe (including aggressive animals, unsafe electrical conditions, hazardous debris, or inaccessible equipment). FixMyPool is not liable for delays, inability to complete service, or damages caused by unsafe, obstructed, or hazardous conditions.
To the fullest extent permitted by law, FixMyPool shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of use, loss of enjoyment, lost profits, business interruption, water damage, chemical damage, plaster/surface damage, corrosion, or equipment failure occurring after service.
FixMyPool’s total liability for any claim arising from or related to the Services or Website shall not exceed the amount paid for the specific service giving rise to the claim.
Customer’s sole remedy for any service-related claim shall be limited to re-performance of the service or refund of the service fee, at FixMyPool’s sole discretion, to the extent permitted by law.
Payments may be processed through Stripe or other payment processors. Customer agrees to provide valid payment information and authorizes charges for booked services and approved additional work.
Customer agrees not to initiate chargebacks or payment disputes for valid services rendered. If there is a concern, Customer must contact FixMyPool first so we can attempt to resolve the issue.
By submitting payment for any FixMyPool service (including via Stripe, online checkout, invoice payment link, or any payment processor), Customer acknowledges and agrees to these Terms of Service and the Privacy Policy located at: fixmypool.pro/terms-of-service.html and fixmypool.pro/privacy-policy.html.
Payment constitutes legally binding acceptance of this agreement. If a payment dispute is initiated without first contacting FixMyPool to attempt resolution, Customer agrees to reimburse FixMyPool for reasonable costs associated with the dispute (including chargeback fees and reasonable administrative costs), to the extent permitted by law. FixMyPool reserves the right to pursue collection for unpaid or fraudulently disputed charges.
Appointment times are estimates and may be affected by weather, traffic, emergencies, prior jobs running long, equipment availability, or other factors. We are not liable for delays outside our reasonable control.
FixMyPool is not liable for failure or delay in performance due to events beyond our reasonable control, including severe weather, natural disasters, supply shortages, utility outages, or governmental actions.
Our Website may integrate or rely on third-party services (including Stripe for payments, Cal.com for scheduling, and Web3Forms for contact form delivery). FixMyPool is not responsible for outages, errors, or security practices of third parties.
The Website and content are provided “as-is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Website will be uninterrupted, error-free, or free from harmful components.
Customer agrees to indemnify and hold harmless FixMyPool and its contractors from claims, damages, losses, and expenses arising out of or related to customer negligence, unsafe site conditions, improper maintenance, improper chemical handling, or violation of these Terms.
These Terms are governed by the laws of the State of Florida. Any action arising from these Terms or the Services shall be brought in state or federal courts located in Hillsborough County, Florida, and you consent to that jurisdiction and venue.
We may update these Terms at any time. The “Last Updated” date will reflect changes. Continued use of the Website or Services after changes constitutes acceptance of the updated Terms.
